Terms of Service

These Terms are an agreement between you and Boonwerks Inc. ("Boonwerks", "we", "us"), which operates Duri. They cover the Duri apps for iPhone and Android, the duri.ai website and the Duri phone service (the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy.

1. What Duri does

Duri answers calls that your carrier forwards to it, usually calls from numbers you don't know. It asks callers who they are and why they're calling, shows you live captions, recommends whether to pick up, takes messages, warns you about signs of a scam during a call, and can alert family members you choose. Duri can also interpret a call between two languages.

Duri gives recommendations. It can be wrong: it may miss a scam or flag a legitimate caller. You decide whether to answer, what to say and what to do. Duri is not financial, legal or medical advice.

2. Not an emergency service

Duri is not a replacement for your phone service and does not support calls to 911, 988 or other emergency numbers. Use your phone's own dialer for emergencies. Duri needs an internet connection and a carrier that supports call forwarding; call quality and availability depend on both.

3. Who can use Duri

• You must be 18 or older and live in the United States.
• You must give accurate account information and keep your password secure.
• If you set up Duri for another person, such as a parent, you confirm that they know about it and agree to Duri answering their calls, and that you are authorized to manage the account for them.

4. Plans, trial and billing

• Trial. The trial costs $1.99 and lasts 14 days. Unless you cancel before it ends, it becomes a Duri membership at $19.99 a month, charged to the card you used for the trial. The $1.99 trial fee is not refundable.
• Membership. $19.99 a month or $199 a year for one protected phone, renewing automatically until you cancel. A second protected phone on the same account is $9.99 a month. Each protected phone includes 600 credits a month.
• Credits. One credit covers one call Duri screens, or one minute Duri helps on a connected call. Monthly credits are added at the start of each billing period. Unused monthly and trial credits end with their period and do not roll over. You can buy extra credit packs (250 for $9.99, 750 for $24.99); pack credits do not expire while your account is open.
• Where you pay. Plans and credits are sold only on duri.ai and billed by Boonwerks through our payment processor, Stripe. The Duri apps do not sell anything.
• Price changes. We will tell you at least 30 days before a price change takes effect for your membership. You can cancel before it does.
• Taxes. Prices may not include sales tax, which we add where required.

5. Cancelling and refunds

You can cancel anytime in your account on duri.ai. Cancelling stops the next renewal; you keep your plan until the end of the period you paid for. Refunds are explained in our Refund Policy.

6. Acceptable use

You may not use Duri to:

• break the law, or record or transcribe calls where you don't have the consent the law requires;
• harass, threaten, defraud or impersonate anyone;
• send spam or robocalls, or resell or commercially exploit the Service;
• interfere with the Service, other users or emergency services, or try to get around its security.

7. Your content

You keep ownership of your calls, transcripts and messages. You give us permission to process them only to provide, secure and improve the Service, as described in the Privacy Policy.

8. Changes and availability

We work to keep Duri available but can't promise it will be uninterrupted or error-free. We may change or improve features. If we change these Terms in a way that matters, we will tell you at least 30 days before the change takes effect.

9. Ending your account

You can delete your account at any time (see Delete your account). We may suspend or close an account that breaks these Terms or puts others at risk. If we close your account without cause, we will refund any unused prepaid period.

10. Disclaimers

To the extent the law allows, the Service is provided "as is". We do not promise that Duri will detect every scam or that every legitimate call will reach you.

11. Limitation of liability

To the extent the law allows, Boonwerks is not liable for indirect, incidental, special, consequential or punitive damages, including money lost to a scam, and our total liability is limited to the amount you paid us for the Service in the 12 months before the claim. Some states don't allow these limits, so they may not apply to you.

12. Disputes and governing law

If you have a problem, please contact us first at team@duri.ai so we can try to fix it. These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-law rules, except where the law of your state requires otherwise.
